On January 14, 2014 at approximately 1:45 p.m., OSP Northern Command Center dispatch received a report that a male subject driving a passenger car was stopped in front of a Creswell School District school bus on the side of the northbound lanes of Interstate 5 north of Creswell near milepost 185. An additional report came in indicating the man appeared to intentionally collide his car into the bus more than once. The bus was occupied by two adults and no students. The adult female bus driver closed the door to prevent entry as the man, who was reported to be armed with a firearm, also took his pants off and then was trying to forcibly enter the bus.
OSP troopers, Lane County deputies and local emergency responders began responding to the area.
Before arrival, the man got back into the 2003 Volkswagen GTI and started to drive away, sideswiping another vehicle. An OSP trooper spotted the car after it left the scene northbound with two reported flat tires. The trooper tried to stop the car and the driver attempted to elude for a short distance northbound before traveling off the traffic lanes near milepost 186. The car went through a fence and into water where it was submerged up to the windows. The male driver eventually got out of the vehicle and came to shore where he was taken into custody by OSP troopers without further incident at approximately 1:55 p.m.
The suspect, Jonathan David Modesitt, age 38, from Bothell, Washington, was checked by medical responders at the scene and was not taken to a hospital. OSP transported Modesitt to the Lane County Jail where he was to be lodged for Felony Attempt to Elude in a Vehicle, DUII, Reckless Driving, Recklessly Endangering Another Person, misdemeanor Hit & Run - Property Damage, Disorderly Conduct in the Second Degree, Criminal Mischief in the First Degree, and Felon in Possession of a Firearm. Additional charges may be pending based on the ongoing investigation.
